Last Friday, the Iowa Supreme Court reversed its former ruling stating that the state constitution protects abortion as a fundamental right in the case of Planned Parenthood of the Heartland, Inc. v. Reynolds. The court explains its ruling stating “Its rhetoric is one-sided. Its constitutional footing is unsound”. The Iowa Supreme Court, however, did not take a position on the litigation standard for abortion cases but instead remanded the case so that the parties could brief the litigation standard issue. The court will be relying on the upcoming Supreme Court decision in Dobbs v. Jackson Women’s Health Organization to provide direction on what standard to implement in abortion cases.
